#82 A Strategy Session for Website Legal Documents

I have a lot of strategy sessions with new clients who are trying to get their heads around what legal documents they need, why they need them and what to do with them when they’re done.

In this episode, I’m taking you through my approach to these valuable strategy sessions, specifically regarding website legal documents.

The first thing I always do in a strategy session is take time to understand the business. I ask a lot of questions about the services they offer and the programs and courses they have available to really understand what type of legal protection they need.

If you’ve listened to this podcast before, you’d be well aware that Website Ts & Cs and a Privacy Policy are an absolute must for any business. Beyond that, there are many variables involved and there is no cookie cutter approach. Legal documents must be tailored specifically to each business in order to make sure that every legal obligation is being met.

These strategy sessions help my clients gain a clear understanding of what their specific legal obligations are, what it is they need to protect, and the best practice to establish trust and build credibility with their clients.

A lot of people have asked me how my strategy sessions work so this episode will give you a feel for how I work and give you an understanding of the many moving parts involved in creating beautifully tailored legal documents.

TOPICS DISCUSSED AND WHERE TO FIND THEM:

[00:35]: A lot of questions I’ve had from clients lately relate to website legal documents. This episode will give you an insight into how I work with clients in a strategy session.

[1:26]: The first thing I always do is take time to understand the business. I’ll take a look at an existing website to determine what legal protection I need to cover based on what they want the website to be doing.

[2:25]: Once I have clarity around the services, blogs, programs and courses, products available for sale, I flesh out a draft plan of what we need to include in the website legal documents. This will always include website Ts & Cs and privacy policy.

[3:45]: Then I dive into the programs and courses and do a Q&A about payment terms, and payment plans to empower them to know what the options are and guide them around best practices.

[4:55]: We cover what’s included in the course and how we can protect intellectual property. I also ask questions about testimonials and feedback to use for marketing, sales pages and future iterations of the course.

[5:45]: I then talk through how the Ts & Cs are communicated to participants to make sure that the client is complying with their Consumer law obligations. This is where clickwrap is needed and I explain how this works.

[6:45]: Sometimes my clients don’t want anyone to sign up until they have a discovery call. In this case, they want to issue an agreement or separate Ts & Cs after they determine they are the right fit. It’s important for me to know this is the process they want to follow.

[7:55]: There is no one size fits all or cookie cutter approach. These strategy sessions give me the opportunity to explain to my client what their options are, what works well, what will leave them exposed and what they need to do.

[8:30]: These strategy sessions give a clear understanding of what your legal obligations are, what you need protected and what is best practice to establish trust and credibility with your clients.
